Terms of Service

Welcome to Pixmivo ("we", "us", "our"), an AI creation studio that generates video, image, and audio content from your text prompts and uploads. These Terms of Service ("Terms") form a binding agreement between you and Pixmivo.

1. Acceptance of these Terms

By accessing or using the service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the service. By using it, you represent that you meet this requirement and that you are not barred from using the service under any applicable law.

3. Your account

We use Google sign-in to create and authenticate your account. You are responsible for the activity that occurs under your account and for keeping your Google credentials secure. Notify us promptly of any unauthorized use.

4. Credits and subscriptions

• The service runs on a credit system. Generations consume credits at rates shown before each run. Credits may be purchased in packs or granted through subscriptions, promotions, or redemption codes.
• Credits are a prepaid license to use the service. They have no cash value, are non-transferable, and cannot be exchanged for money except where required by law.
• Subscriptions renew automatically each billing period until canceled. You may cancel at any time through the billing portal; access and benefits continue until the end of the paid period.
• Prices and credit rates may change. Changes apply to future purchases and renewals, not to credits you already hold.

5. Acceptable use

You agree not to use the service to create, upload, or distribute content that:

• is illegal, or infringes the intellectual property, privacy, or other rights of any person;
• depicts minors in any sexual or exploitative manner (we report apparent child sexual abuse material to the authorities);
• is intended to harass, defame, threaten, or impersonate others, or to create deceptive deepfakes of real people without consent;
• promotes violence, self-harm, or illegal activity, or that violates the content policies of our upstream model providers;
• attempts to bypass usage limits, reverse engineer the service, scrape it at scale, or interfere with its security or operation.

We may suspend or terminate accounts that violate these rules and may remove content at our discretion.

6. Your content and generated output

• You retain ownership of the prompts and files you submit (“Inputs”). You represent that you have the rights necessary to submit them.
• Subject to your compliance with these Terms and the terms of the underlying model providers, you own the outputs you generate (“Outputs”) and may use them for personal or commercial purposes.
• AI-generated content may be similar to content generated for other users, and copyright in AI output can be uncertain in some jurisdictions. You are responsible for how you use Outputs.
• You grant us a limited license to process, store, and deliver your Inputs and Outputs solely to operate and improve the service.

7. Third-party services

Generation is performed through third-party AI model aggregators. Payments are processed by third-party payment providers, and media is stored with third-party cloud storage. Your use of these features is also subject to those providers' terms. We are not responsible for third-party services beyond our control.

8. Availability and changes

We may modify, suspend, or discontinue any part of the service at any time. We aim for high availability but do not guarantee uninterrupted or error-free operation.

9. Termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that creates risk or legal exposure. Unused credits are generally non-refundable on termination for cause.

10. Disclaimers and limitation of liability

The service and all Outputs are provided “as is” without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim. 11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use after changes means you accept the revised Terms.

Privacy Policy

This Privacy Policy explains what information Pixmivo collects, how we use it, and the choices you have. We aim to collect only what we need to run the service.

1. Information we collect

• Account information: when you sign in with Google, we receive your name, email address, and profile picture.
• Content you provide: the prompts, text, and files (such as images) you submit for generation, and the media we generate for you.
• Transaction data: your credit balance, generation history, purchases, subscription status, and redemption activity. Card details are handled by our payment processor, not stored by us.
• Technical data: IP address, device and browser information, and log data used for security, rate limiting, and debugging.
• Cookies: a small set of cookies and similar storage for sign-in sessions, your language preference, and analytics.

2. How we use your information

• To provide the service: authenticate you, run generations, deliver and store your outputs, and maintain your credit ledger.
• To process payments and manage subscriptions and refunds.
• To secure the service: prevent abuse, enforce rate limits, and investigate incidents.
• To improve the service and understand aggregate usage through analytics.
• To comply with legal obligations and respond to lawful requests.

3. Service providers we share data with

We share the minimum data necessary with providers who help us operate, including:

• Identity: Google, for sign-in.
• AI generation: third-party model aggregators that process your prompts and uploads to produce outputs.
• Payments: third-party payment processors that handle checkout and billing.
• Storage: cloud object storage that hosts your generated media.
• Analytics: privacy-conscious analytics tools (e.g. Google Analytics and an advertising pixel) where enabled.

We do not sell your personal information.

4. Cookies

We use strictly necessary cookies for authentication and your language preference, and optional analytics cookies to understand usage. You can control cookies through your browser settings; disabling necessary cookies may break sign-in.

5. Data retention

We keep account and transaction records for as long as your account is active and as needed for legal, accounting, and security purposes. Generated media is retained so it remains available in your gallery; you may request deletion of specific content or your account.

6. Your rights

Depending on where you live (including under the GDPR and similar laws), you may have the right to access, correct, export, or delete your personal data, and to object to or restrict certain processing. 7. International transfers

We and our providers may process data in countries other than where you live. Where required, we rely on appropriate safeguards for such transfers.

8. Security

We use technical and organizational measures such as encryption in transit, access controls, and secret management to protect your data. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. Children

The service is not directed to children and is intended for users 18 and older. We do not knowingly collect personal data from children. If you believe a child has provided us data, contact us and we will delete it.

Refund Policy

Credits and subscriptions unlock immediate access to digital generation services. This policy explains when refunds apply.

1. Failed generations are auto-refunded

If a generation fails for a technical reason on our side, the credits for that run are automatically returned to your balance. You do not need to contact us for these.

2. Credit packs

Purchased credits are non-refundable once they have been used, because the underlying compute is consumed at generation time. If you have a large, unused balance and believe a purchase was made in error, contact us within 14 days and we will review it on a good-faith basis.

3. Subscriptions

• You can cancel a subscription at any time through the billing portal. Cancellation stops future renewals; you keep access and any included credits until the end of the current paid period.
• Payments already made for the current period are generally non-refundable, and we do not pro-rate partial periods, except where required by law.
• If you were charged after canceling, or were billed in error, contact us and we will correct it.

4. How to request a refund

Email support@pixmivo.com from the address on your account, with your order or transaction details and a short description of the issue. Approved refunds are returned to the original payment method.

5. Chargebacks

Please contact us before initiating a chargeback so we can resolve the issue directly. Accounts with fraudulent chargebacks may be suspended.
